Welcome to Golooka. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not accept these terms, please do not use Golooka.
1. Definitions
- "Platform" refers to the Golooka website, mobile application, and associated services.
- "User" refers to any person who creates an account on Golooka, whether a job seeker or an employer.
- "Job Seeker" refers to a user who uses Golooka to search for and apply to job postings.
- "Employer" refers to a user or organization that posts job listings and manages applications on Golooka.
- "Content" refers to any text, images, documents, or other material published on the platform.
2. Eligibility
To use Golooka, you must:
- Be at least 18 years old.
- Provide accurate and complete information during registration.
- Maintain the confidentiality of your login credentials.
- Have the legal capacity to enter into binding agreements.
3. Account Creation and Management
3.1 Registration
You can create an account using your email address, phone number, or through a social authentication provider. You must choose a role (job seeker or employer) during registration.
3.2 Account Security
You are responsible for maintaining the security of your account. We strongly recommend enabling two-factor authentication (2FA). Please notify us immediately if you suspect unauthorized access to your account.
3.3 Company Profiles and Team Management
Employers can create a company profile and invite team members with defined roles (owner, admin, recruiter, member). The company owner is responsible for actions taken by their team members on the platform.
4.1 For Job Seekers
- You can create a profile, upload resumes, search for job postings, and apply for positions.
- Your applications are submitted with a cover letter and your profile information.
- You can track the status of your applications and communicate directly with employers through our messaging system.
- Duplicate applications to the same job posting are automatically blocked.
4.2 For Employers
- You can post job listings, manage applications, and communicate with candidates.
- Job postings must be accurate, lawful, and compliant with local employment laws.
- You can track candidates through a structured recruitment pipeline and add internal notes.
- Recruitment analytics are provided to measure job posting performance.
4.3 Messaging
The messaging system is intended for recruitment-related communications between candidates and employers. Any misuse of the messaging system (spam, harassment, solicitation) is prohibited.
5. User Conduct
By using Golooka, you agree not to:
- Post false, misleading, defamatory, or illegal content.
- Impersonate another person or organization.
- Use the platform for purposes other than recruitment and job searching.
- Attempt unauthorized access to other users' accounts or platform systems.
- Send spam, unsolicited messages, or promotional content through the messaging system.
- Post discriminatory job listings or those that violate applicable employment laws.
- Circumvent security mechanisms, including CAPTCHA verification and rate limits.
6. Content Moderation
Golooka uses automated moderation systems to detect inappropriate content, including:
- Job postings and cover letters are analyzed for inappropriate language before publication.
- We reserve the right to remove any content that violates these terms.
- Accounts that repeatedly violate our policies may be suspended or terminated.
7. Intellectual Property
- Golooka owns the entire platform, including its design, features, and underlying technology.
- Users retain ownership of the content they publish (resumes, job descriptions, company logos).
- By posting content on Golooka, you grant us a non-exclusive, worldwide license to display and distribute that content as part of the platform's operation.
8. Payments and Subscriptions
- Certain Golooka features require payment, including premium job postings and advanced recruitment tools.
- Payments are processed through secure third-party providers, including M-Pesa.
- All sales are final unless otherwise stated in the specific offer.
- We reserve the right to change our pricing with reasonable notice.
9. Data Privacy
Your use of Golooka is also governed by our Privacy Policy, which details how we collect, use, and protect your data. By using the platform, you consent to our data practices as described in the Privacy Policy.
10. Disclaimers
- Golooka is provided "as is" and "as available."
- We do not guarantee that job seekers will find employment or that employers will find qualified candidates.
- We are not responsible for the accuracy of information posted by users.
- We are not a party to employment agreements made between job seekers and employers.
- We cannot guarantee uninterrupted availability of the platform.
11. Limitation of Liability
To the fullest extent permitted by law, Golooka and its officers, employees, and partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.
12. Termination
- You may delete your account at any time from your profile settings.
- We may suspend or terminate your account if you violate these terms.
- Upon termination, your data will be handled in accordance with our Privacy Policy.
13. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of significant changes. Your continued use of the platform after changes constitutes your acceptance of the updated terms.
14. Governing Law
These terms are governed by the laws of the Democratic Republic of the Congo. Any disputes shall be submitted to the exclusive jurisdiction of the courts of the Democratic Republic of the Congo.
